Terms and Conditions

1. Definitions and Interpretation

In these Terms and Conditions:

• "Company", "we", "us", "our" - refers to Kiddie Fiesta, registered in New Delhi, India.
• "Customer", "you", "your" - the person or organization renting equipment from Kiddie Fiesta.
• "Equipment" - all items rented from Kiddie Fiesta, including play structures, decorations, furniture, and accessories.
• "Services" - delivery, installation, dismantling, and other related services provided by the company.
• "Order" - confirmed request for equipment rental and/or service provision.

2. Booking and Payment

2.1 Booking Process: To place an order, you need to:

• Complete the order form on the website or by phone
• Confirm event details (date, time, location)
• Make a deposit to secure the booking

2.2 Payment Terms:

• A 50% deposit of the order value is required to confirm the booking
• Full payment must be made no later than 48 hours before the event
• For orders placed less than 48 hours in advance, full payment is required at the time of booking

2.3 Payment Methods: We accept the following payment methods:

• Credit and debit cards (Visa, Mastercard, RuPay)
• Electronic wallets (PayTm, GooglePay, PhonePe)
• Bank transfer
• Cash (only with prior arrangement)

3. Delivery and Installation

3.1 Delivery Schedule: Equipment delivery and installation are carried out at the agreed time. The customer or their representative must be present to provide access to the installation site.

3.2 Installation Site Requirements:

• Access to the installation site must be free and safe
• The installation site must meet safety requirements (level surface, no obstacles)
• Inflatable structures require access to power within 15 meters

3.3 Equipment Inspection: Upon delivery, the customer should inspect the equipment for damage or defects and immediately report them to the company representative.

4. Equipment Use

4.1 Safety Rules: The customer agrees to:

• Ensure constant adult supervision of children using the equipment
• Observe the maximum allowable number of children for each type of equipment
• Not allow children younger or older than the specified age range to use the equipment
• Prohibit equipment use during adverse weather conditions (strong wind, thunderstorm, heavy rain)

4.2 Usage Restrictions: It is strictly prohibited to:

• Use equipment by adults (except specially designated items)
• Consume food and drinks on/inside inflatable structures
• Wear shoes, glasses, or carry sharp or hard objects when using inflatable structures
• Move installed equipment without company approval
• Make any modifications to the equipment structure

5. Liability and Damage Compensation

5.1 Customer Responsibility: The customer is responsible for:

• Equipment safety during the rental period
• Any damage caused to equipment due to improper use
• Ensuring children's safety when using the equipment

5.2 Damage Compensation: In case of damage, loss, or theft of equipment:

• The customer must immediately notify the company
• For inflatable structures - repair cost or full replacement cost (depending on damage severity)
• For other items - full replacement cost plus 15% administrative fee

5.3 Company Liability Limitation: Kiddie Fiesta is not responsible for:

• Injuries resulting from improper equipment use
• Damage to customer property during installation or use of equipment (provided our instructions were followed)
• Inability to provide services due to force majeure circumstances

6. Cancellation and Order Changes

6.1 Cancellation Policy:

• Cancellation 14+ days before the event - 100% deposit refund
• Cancellation 7-13 days before the event - 50% deposit refund
• Cancellation 3-6 days before the event - 25% deposit refund
• Cancellation less than 3 days before the event - no deposit refund

6.2 Order Changes:

• Order changes are accepted no later than 72 hours before the event
• Adding equipment or services is possible subject to availability and after additional payment
• Reducing equipment or services is subject to the cancellation policy

6.3 Weather-Related Cancellation: In case of adverse weather conditions:

• The company reserves the right to cancel inflatable equipment provision for safety reasons
• The customer will be offered an alternative or rescheduling to another date
• If rescheduling is not possible - 100% deposit refund

7. Intellectual Property

7.1 Ownership Rights: All intellectual property rights (including copyrights, trademarks, patents) for equipment, website, marketing materials, and other items belong to Kiddie Fiesta or are licensed to the company.

7.2 Usage Restrictions: The customer may not:

• Copy the design, structure, or appearance of equipment
• Use Kiddie Fiesta's logo, name, or other brand elements without written permission
• Photograph or record video of equipment for commercial purposes without approval

8. Confidentiality

All customer information is processed in accordance with our Privacy Policy. By using our services, you agree to the terms of personal data processing.

9. Force Majeure

Kiddie Fiesta is not liable for failure to fulfill obligations in case of force majeure circumstances, including but not limited to: natural disasters, terrorist acts, civil unrest, government restrictions, pandemics, strikes, or other events beyond the reasonable control of the company.

10. Dispute Resolution

10.1 Applicable Law: These Terms are governed by and construed in accordance with the laws of India.

10.2 Dispute Resolution Procedure:

• The parties will seek to resolve any disputes through negotiation
• If a dispute cannot be resolved through negotiation within 30 days, it will be submitted to the competent court in New Delhi, India

11. Terms Changes

Kiddie Fiesta reserves the right to modify these Terms at any time. Updated terms become effective upon publication on the website. We recommend periodically checking this page to review the current version.

12. Entire Agreement

These Terms, together with the order confirmation and any additional conditions specified on our website, constitute the entire agreement between the customer and Kiddie Fiesta regarding the subject matter of these Terms and supersede all previous agreements between the parties.
